Are prenuptial agreements legally binding in the UK?
Prenuptial agreements are not automatically binding, but the courts will usually uphold a fair agreement that both people entered into freely, with proper advice and full disclosure. We draft yours to meet those requirements so it carries real weight.
Can we make an agreement after we are married?
Yes. A postnuptial agreement does the same job as a prenup but is made after the wedding. It can be just as effective when it is properly drawn up.
When should we start a prenup?
As early as possible before the wedding. An agreement signed in a rush at the last minute is easier to challenge. We recommend starting well ahead, so there is time for advice and disclosure on both sides.
What can a prenup cover?
Typically how property, savings, pensions, businesses and inheritances would be divided, and how finances would be handled during the marriage. It cannot decide arrangements for children, which are always based on their welfare at the time.
